Safe Date, LLC ("Safe Date," "Company," "we," "our," or "us") takes your privacy seriously and wants you to understand how we manage your information. This Privacy Policy, which is incorporated into our Terms of Use, describes how we collect, use, disclose, and protect information in connection with your ("you" or "your") access to and use of our website, mobile applications, products, and services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy and agree to our collection, use, and disclosure of information as described here, as well as our Terms of Use, Consumer Health Data Policy, Community Guidelines, and (for Colorado users) our Colorado Safety Policy.

The Service is intended for users located in the United States. If you access the Service from outside the United States, you understand that your information will be transferred to and processed in the United States, which may have different data protection laws than your home jurisdiction.

1. WHAT DOES THIS PRIVACY POLICY COVER?

This Privacy Policy explains how we collect, use, and disclose information, both online and offline, in connection with the Service.
It does not apply to:

  • Third-party websites, apps, or services that may be linked from or integrated with the Service; or
  • Third-party practices or services outside our control ("Third Party Platforms"), even if referenced in or accessible from the Service.

Each Third-Party Platform has its own privacy practices and policies, which we encourage you to review before using.

2. WHAT INFORMATION DO WE COLLECT?

In this Privacy Policy, "personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

Some personal information we collect may be considered "sensitive personal information" or "sensitive data" under applicable law (for example, precise location, racial or ethnic origin, religious beliefs, sexual orientation, and biometric identifiers or templates used for identity verification). The Service is not intended to collect medical records or detailed health care information. To the extent information you share reveals health related details (for example, about your lifestyle or mental health), that information is provided voluntarily by you and is handled as personal information under this Privacy Policy and, where applicable, under our Consumer Health Data Policy.

We collect information from you, from your devices, and from third parties. Below are the categories of information we collect or have collected.

3. HOW DO WE COLLECT AND USE INFORMATION?

We collect personal information directly from you at various points during your sign-up, purchase, setup, and use of the Service, for example:

  • When you apply for membership to the Service.
  • When you register a user account.
  • When you install or use our app.
  • When you click a link on an advertisement for the Service.
  • When you upload and share your Content through the Service.
  • When you post reviews or comments on the Service or our social media channels.
  • When you communicate with us, such as by speaking to one of our customer services agents.
  • When you sign up to receive email, text/SMS, or other communications from us.
  • When you participate in a survey or contest.
  • When you fill out a form on the Service.

We also collect personal information from third parties, such as:

  • Service Providers: When you apply for membership, we collect information about you from our identification verification service providers.
  • Users: Other users may provide information about you as they use our Service, for instance as they interact with you or if they submit a report involving you.
  • Social Media: You may decide to share information with us through your social media account, for instance if you decide to create and log into your account via your social media or other account (e.g., Facebook, Google or Apple) or to upload onto our Service information such as photos from one of your social media accounts (e.g., Instagram).
  • Other Partners: We may receive information about you from our partners where our ads are published on a partner's service (in which case they may pass along details on a campaign's success).

Finally, like most websites and apps, we also collect personal information through automated technologies, such as cookies, web beacons, and pixels. These practices are discussed more fully in the section below entitled "How Do We Use Cookies and Similar Technologies?"

We collect and use personal information for our business purposes, namely, to provide and improve our Service. Part of this includes compliance with applicable laws, such as responding to legal requests, enforcing this Privacy Policy and our rights, and protecting others and our Service. We may also use information for short-term, transient use for an interaction with you and to personalize your experience and communications. We also use your information to provide the features of our Service, including allowing you to create your account/user profile, provide you with customer support, and communicate with you about the Service. We use information for security purposes and to protect against harmful activity. We may use information for debugging for functionality, auditing interactions, and internal research. We also use information as instructed by you and with your consent.

In addition, we collect and use information for commercial purposes, meaning to market our goods and services. For example, we collect device and other data to better target advertisements and other content to create a more personally relevant experience.

We may process sensitive personal information and biometric information to verify identity and age, promote safety and integrity, enforce our Terms and safety policies, and comply with legal obligations, where permitted by law. We do not use sensitive personal information or biometric information for purposes of cross-context behavioral advertising, nor do we "sell" this information for monetary consideration.

Where applicable law grants you the right to limit certain uses or disclosures of sensitive-personal information, you may exercise those rights as described in the "Your Privacy Rights and Choices" section of our Privacy Policy.

We use sensitive personal information only for purposes that are reasonably necessary and proportionate to provide the Service, to ensure security and integrity, to prevent fraud and illegal activity, and to comply with law; we do not use it for additional, unrelated purposes without your consent or as otherwise permitted by law.

4. HOW DO WE USE COOKIES AND SIMILAR TECHNOLOGIES?

When you use the Service or interact with our online content, we and our service providers may use cookies, pixels, web beacons, SDKs, log files, and similar technologies ("cookies") to automatically collect certain information and to help the Service function properly. These technologies allow us to recognize you and keep you signed in; remember your preferences and settings; understand how the Service is used, and which features are most popular; detect, investigate, and prevent fraud, spam, and abuse; and support advertising and marketing, where permitted by law. 5. HOW DO WE SHARE YOUR INFORMATION?

As part of our business, we disclose information as follows and for the purposes outlined above, which include business purposes to provide and improve the Service and comply with legal and contractual obligations, as well as commercial purposes, such as to market our business:

  • Service Providers and Contractors. We engage certain trusted third parties to perform functions and provide services to us, for example, our identification verification service provider. This may include the disclosure of sensitive personal information and biometric information (for example, verification photos and ID information) to specialized identity verification and safety providers, payment processors, hosting providers, security vendors, and other service providers that process such information on our behalf and under our instructions. Such disclosure is for business purposes of providing you with products and services that you have requested or considered.
  • With Other Users. Your information will be shared with other users when you voluntarily disclose it through your use of the Service. Sensitive personal information that you choose to include in your profile or Public Information (such as sexual orientation, religious beliefs, or racial/ethnic background) will be visible to other users consistent with your profile settings and the design of the Service. Please be careful with your information and make sure that the content you share is something you would be comfortable being publicly viewable. Remember, neither you nor we can have total control over what others do with your information once you share it. We may also share your public content, such as reviews and comments about the Service, including by reposting your reviews in our advertising and through our social media accounts. We cannot control and are not responsible for how other users or third parties use, copy, or share information you choose to disclose through the Service, whether in private messages or public areas. You should not expect confidentiality for information you share with other users.
  • Disclosure in Connection with the Service. We may disclose information when necessary to provide the Service, including without limitation, with those who perform technical, administrative, and data processing tasks such as hosting, billing, customer support, marketing, and data storage.
  • Affiliated Entities. Should we be subject to an acquisition, merger, sale or other change of control or business entity status, or bankruptcy, we reserve the right to transfer or assign your information as part of that acquisition, merger, sale, or bankruptcy. We may also share your information with any affiliated entities, which are businesses that are directly related to us and have common ownership, where your information is still treated in accordance with this Privacy Policy.
  • Government Officials and Other Parties. To comply with any legal obligations, we may disclose your information in response to subpoenas, court orders, and other valid legal processes. We may also disclose personal information when we believe it is necessary to prevent illegal, fraudulent, or injurious actions that may cause harm to individuals. Where required by law or appropriate to protect safety or our rights, we may disclose sensitive personal information and biometric information to law enforcement or other authorities, for example in response to a subpoena, court order, or lawful request related to fraud, abuse, or safety concerns.
  • Advertising Partners. We may disclose information as needed to advertising partners. For example, we may share information gathered through cookies and tracking tools to allow a third party to advertise our products to you after you leave the Service.
  • Consent. We may disclose information as requested or consented to by you. Such disclosure may be for any business or commercial purpose as described to you.

6. DO WE SELL OR SHARE INFORMATION?

We only sell or share data as outlined in this Privacy Policy. For example, our use of online tracking technologies may be considered a "sale" or "sharing" under applicable law. To opt out of these practices, contact us as outlined below and see our Do Not Sell or Share My Personal Information link.

We do not sell or share sensitive personal information or biometric information for purposes of cross context behavioral advertising or to build consumer profiles for third party marketing. We may disclose such information to our service providers and processors as necessary to provide the Service, for security and safety purposes, and to comply with legal obligations.

7. HOW DO WE PROTECT AND TRANSFER INFORMATION?

Consistent with others in our industry, we take efforts to employ technical, administrative, and physical security measures for personal information, including sensitive personal information and biometric information, considering reasonable security procedures and accessible technology. However, no system can be completely secure; and we cannot promise, and you should not expect, that your personal information will always remain secure. Your provision of personal information is at your own risk. The safety and security of your information also depend on you. Take steps to safeguard your passwords and other data and notify us as soon as possible if you believe your account security has been breached. We transfer, process, and store data only via reputable and trusted cloud service providers.

If you are visiting the Service from a location outside of the United States, your connection will be through and to servers located in the United States, and all information you provide will be processed and securely maintained in our web servers and internal systems located within the United States. By using the Service, you authorize and specifically consent to the transfer of personal data to the United States and its storage and use as specified in this Privacy Policy.

8. HOW LONG DO WE RETAIN INFORMATION?

We retain personal information for the length of time necessary to fulfill the purposes outlined in this Privacy Policy unless a different retention period is requested by you or required or permitted by law. For example, we will retain your personal information for as long as it is needed to provide you with the Service or fulfill a legal or contractual obligation. We may also aggregate, deidentify, or anonymize personal information as applicable for use in analytics, such as to analyze trends over periods of time without specifically identifying you.

We use the following criteria to determine how long we retain personal information: (a) our relationship with you, such as if there is an open contract or account or a pending transaction or request; (b) legal obligations to retain personal information for certain purposes, such as to maintain transaction records; and (c) other obligations or considerations relating to the retention of data, such as contract requirements, litigation holds, investigations, or statutes of limitation.

9. WHAT ARE YOUR PRIVACY RIGHTS?

We value consumer privacy rights and strive to provide flexibility with how your personal data is used and shared. If you want to make a privacy request or have any questions, please contact us through our Contact Form or email customerservice@safedate.net with your name and email address or other identifier used in connection with our Service so that we can verify your request. If an authorized agent is making a request on your behalf, the agent should provide its name and contact information, such as an email address, in addition to your information. There may be situations where we cannot grant your request; for example, if you make a request and we cannot verify your identity, or if you request deletion of data that we have a legal obligation to keep. Where we deny your request in whole or in part, we will take steps to inform you of the denial and provide an explanation of our actions and the reasons for the denial.

Applicable privacy laws have different requirements and depend on various factors, such as where you live and how much revenue or data is at issue. We adhere to the following set of privacy rights to the extent applicable and subject to any limitations authorized by law.

  • Access. You can access and obtain your data and ask us for certain information, including: the categories of personal information collected and used; the categories of the sources of data; the business or commercial purposes for collecting, selling, or sharing data; the categories of third parties to whom data is disclosed; and the specific pieces of personal information collected. You also have a similar right to data portability (the ability to export, back up, and transfer data).
  • Amend. You can amend, correct, or rectify your data if it is inaccurate.
  • Delete. You can have your data deleted subject to certain legal limitations.
  • Limit. You can limit the processing of your data, in particular any sensitive data, and limit use of automated decision making, such as profiling.
  • Opt-Out. You have the right to opt-out of certain data practices. For example, you can

unsubscribe from marketing communications by following the opt-out instructions in each message or by contacting us as outlined in this Privacy Policy (please note that we may still send non-marketing messages, and that consent to receiving marketing communications is not mandatory to use the Service). You may also opt out of the "sale" or "sharing" or your personal information to the extent applicable. Please see our Do Not Sell or Share My Personal Information link. You may opt out of the use of automated decision-making technology if applicable. We will also respond to recognized global opt-out preference signals where we can verify the request. For more information, see below. We do not 'sell' or 'share' sensitive personal information or biometric information for cross context behavioral advertising. Opt out rights for 'sale' or 'sharing' apply to non sensitive categories (such as online identifiers and internet activity), as described in Section 6.

  • Complaints. You have the right to make certain complaints, including for privacy concerns. We value your feedback and seek the opportunity to work with you on any issues. You have the right to no discrimination for asserting your privacy rights.
  • Specific State Laws. Several states have enacted privacy laws that may apply to you, depending on the circumstances. For example, the California Consumer Privacy Act ("CCPA"), updated by the California Privacy Rights Act ("CPRA"), governs certain California-related conduct. Under California's "Shine the Light" law, California residents may also request certain information regarding Company sharing personal information with third parties for their direct marketing purposes. Further, if you are a California resident under the age of eighteen, California Business & Professions Code Section 22581 permits you to request and obtain removal of content you have publicly posted. Please note that such a request does not ensure complete or comprehensive removal of public content.
  • European Laws. If you are located in the European Economic Area ("EEA"), you may have the right to access information we hold about you; to ask that your information be corrected, updated, or erased; and the right to object to, or request that we restrict, certain processing of your information. Our legal basis for collecting and using your personal data is your consent, the fulfillment of our obligations pursuant to the contract created between you and Company, or where the collection and use is in our legitimate interests and does not violate your data protection interests or fundamental rights. You may withdraw your consent from our collection and use of your personal data. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your information used in reliance on lawful processing grounds other than consent.
  • Other Laws. If certain other privacy laws apply to you that provide you with additional rights, please contact us to make a request, as we strive to comply with all privacy rights.

10. PRIVACY PRACTICES OF THIRD PARTIES

The Service may include content or links to content, products or services provided by third parties. This Privacy Policy only addresses the use and disclosure of information by Company through your interaction with the Service. Third Party services that may be accessible through links from the Service have their own privacy policies and information collection, use, and disclosure practices. Third-party sellers, advertisers, and partners also have their own privacy practices. We encourage you to familiarize yourself with the privacy statements provided by these third parties prior to providing them with information or taking advantage of a third-party offer or promotion.

11. HOW DO WE PROTECT THE PRIVACY OF CHILDREN?

Our Service is restricted to users who are eighteen years of age or older. As such, we do not knowingly collect any personal information about children under the age of thirteen. If we obtain actual knowledge that we have collected such information, that information will be immediately deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to third parties.

12. CONSENT TO RECEIVE ELECTRONIC COMMUNICATIONS FROM OTHER USERS

Without limitation, by registering for the Service and/or creating a user profile through the Service, you consent to receive electronic communications, including email, video messages, in-app messages, instant messages, push notifications, and other personal messages from other users of the Service.

13. DO WE OFFER FINANCIAL INCENTIVES FOR YOUR DATA?

No, we do not currently offer any financial incentives for your data.

14. DO WE RESPOND TO DNT SIGNALS OR GPC?

No, our Service does not currently respond to DNT, short for Do Not Track, requests. DNT is a feature that, when enabled, sends a signal to websites to request that your browsing not be tracked.

"GPC" is short for Global Privacy Control settings in your browser or extension. We recognize GPC signals. This means that if your browser has GPC enabled, our website will automatically recognize your GPC signal and treat it as a request to opt out of the sale or sharing of your personal information, if any.

15. HOW DO WE UPDATE THIS PRIVACY POLICY?

We will update this Privacy Policy when our privacy practices change or as otherwise required or permitted by law. Each time you use the Service, the current version of this Privacy Policy will apply. Unless we receive your express consent, any revised Privacy Policy will apply only to information collected after the effective date of the revised Privacy Policy.
